HOW TO ENTER

To be eligible for each entry, individuals must make an online purchase of $100 or more in a single transaction (excluding shipping fees) from any of OZhut* stores between the promotional period dates: September 29, 2023, to December 10, 2023. Multiple entries are allowed.

Only entries with recorded proof of entry will be eligible to participate and these participants will be notified of their entry number.

TERMS AND CONDITIONS

Information on how to enter and the prizes are a part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Eligibility: This promotion is open to Australian residents aged 18 and above. Employees and their immediate families, as well as associated agencies, are not eligible to participate.

Entry Validation: OZhut may verify entrant information and disqualify non-compliant or fraudulent entries. Incomplete, indecipherable, or illegible entries are invalid. Entrants must keep purchase receipts and entry numbers as proof of purchase. Receipts should show the purchase was made during the promotional period.

Entry Period: The promotional period begins on Friday, September 29, 2023, and ends on Friday, December 10, 2023. Entries will be confirmed via email notification 30 days after the order date, and finalized on January 11, 2024.

Prize Draw Mechanism: Verified entries will be listed in a spreadsheet with unique sequential row numbers, alongside details such as order number, timestamp, names, phone numbers, and email addresses. The Prize Draw will be held on January 12, 2024. Winners will be selected using www.random.org's random number generator based on the total number of entries, with each prize having its own winner determined by the generator.

Winners Notification: Winnerswill be notified by phone and via email within 3-7 working days following the Prize Draw. OZhut may publish winning order numbers and suburbs online. OZhut's decisions on winning entries are final, and there will be no further discussion.

Data Privacy: OZhut will handle entrants' personal information in accordance with data protection laws of The Privacy Act 1988 - https://www.legislation.gov.au/Series/C2004A03712

Voucher Prize Validity: Voucher prizes will be valid for 3 months from the date of issue.

Prize Substitution: Prizes are not transferable or exchangeable for cash. OZhut may substitute unavailable prizes with ones of equal value/specification as per regulatory authority guidance.

Media Consent: Entrants consent to OZhut using their name, image, and voice if they win, without compensation, for promotional purposes related to this promotion and OZhut's products, in any media and for an unlimited duration.

Disruptions: OZhut may modify or cancel the promotion due to circumstances beyond its control.

Liability: Except for non-excludable guarantees, OZhut is not liable for any personal injury, loss, or damage arising from the promotion.

Privacy: OZhut collects and uses personal information for the promotion's purposes.

1. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister, or 1st cousin. If there is a dispute as to the identity of an entrant, OZhut reserves the right, in its sole discretion, to determine the identity of the entrant.
   
   
2. Any entrant who submits an entry that does not comply with these Terms and Conditions or who tampers with the entry process may be subject to disqualification. Orders canceled, or amended below the minimum qualifying threshold will be disqualified. Errors and omissions may be accepted at OZhut’s discretion. Failure by OZhut to enforce any of its rights at any stage does not constitute a waiver of those rights.
   
   
3. Failure to produce proof of purchase for all entries when requested may, at OZhut’s absolute discretion, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.
   
   
4. All vouchers won must be redeemed within 3 months of receiving the voucher via email. If for any reason a winner does not redeem their voucher by the specified time, the voucher will be forfeited.
   
   
5. If this promotion is interfered with or is unable to be conducted as reasonably anticipated due to any reason beyond the reasonable control of OZhut, including but not limited to technical difficulties, unauthorized intervention, or fraud, OZhut reserves the right, in its sole discretion, to (a) disqualify any entrant; or (b) subject to any written directions from a regulatory authority, modify, suspend, terminate, or cancel the promotion, as appropriate.

Nothing in these Terms and Conditions limits, excludes, or modifies the statutory consumer guarantees provided under the Competition and Consumer Act 2010 - https://www.legislation.gov.au/Details/C2021C00010, as well as any other implied warranties under the ASIC Act 2001 - https://www.legislation.gov.au/Details/C2021C00281, or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
   Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, OZhut (including its respective officers, employees, and agents) is not responsible for and excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special, or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the OZhut’s control); (b) any theft, unauthorized access, or third-party interference; (c) any entry or prize claim that is late, lost, altered, damaged, or misdirected (whether or not after their receipt by OZhut) due to any reason beyond the reasonable control of OZhut; (d) any variation in prize value from that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
   
7. For the purpose of conducting this promotion, personal information may be disclosed to third parties, including but not limited to agents, contractors, service providers, prize suppliers, and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. OZhut may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research, and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt-out, access, update, or correct information to OZhut. All entries become the property of OZhut.
